TERMS AND CONDITIONS [ERTF1/22]

  1. YOUR CONTRACT WITH EASY RESCUE SERVICES

These terms and conditions relate to the contract between the Tyre Fitting Partner (“you”) and Easy Rescue Services (“Easy Rescue Services”) for work (“jobs”) carried out that has been subcontracted to you by Easy Rescue Services.

It is important that you read and understand these terms and conditions before you sign the contract agreement on the Tyre Fitting Partner Sign-Up Form.

  1. PERIOD OF CONTRACT

The contract between you and Easy Rescue Services lasts for an unlimited period from the date on which the agreement was signed, until thirty days after we have received written notification from you requesting that you wish to terminate your Tyre Fitting Partner agreement for Easy Rescue Services.

  1. TYRE FITTING PARTNER ARRIVAL TIME & PROCESS

3..1 All Tyre Fitting Partners must attend jobs within the timescale agreed at the time of accepting the job from Easy Rescue Services. Our standard attendance SLA is 60-90 mins in all other circumstances.

3.2 All jobs will be accompanied by a job form detailing: the customer name, location of the vehicle, customer telephone number, tyre size (supplied by the customer), agreed price of the job and any information deemed by Easy Rescue Services. You must complete all fields in the Tyre Partner including the customer signature and photo of the tyre fitted. Without the job form being completed your invoice will be returned unpaid.

3.3 Easy Rescue Services cannot be held responsible for inaccuracies in the job form relating to information supplied by the customer. Easy Rescue Services cannot be held liable for any losses incurred by you whatsoever which are a result of information supplied by the customer.

3.4 Should a job be assigned to you, and it cannot be completed due to incorrect information supplied by the customer, the specification of services requested by the customer is incorrect, unknown damage or for any other reasons beyond the control of Easy Rescue a nominal amount of £50 may be paid to you at the discretion of Easy Rescue and on a case-by-case basis.

  1. INVOICING

4.1 Under no circumstances should you discuss any charges for work carried out with our customers, third parties or anyone other than Easy Rescue Services.

4.2 All charges for jobs subcontracted to you by Easy Rescue Services must be charged by you to Easy Rescue Services and only invoices raised by the business name submitted during the sign-up process will be acknowledged and or paid.

4.3 Any payments made from Easy Rescue Services in error must be paid in full back to Easy Rescue Services within 48hrs of you being made aware of the situation.

4.4 The value of each job will be agreed with you upfront. Once you have accepted the offer of the job at the agreed amount, Easy Rescue Services will confirm the amount electronically via text, WhatsApp or email. Only the amount agreed upon and confirmed will be paid unless authorisation has been given prior to the work taking place.

4.5 Invoices for jobs subcontracted to you by Easy Rescue Services should be received by Easy Rescue Services within seven days of the work being completed and invoices will be paid on a 7 days from receipt of invoice basis, providing all terms and conditions are adhered to. For the avoidance of doubt if invoices are not received within the above timescales’ payments may be delayed.

4.6 Invoices received for jobs subcontracted to you by Easy Rescue Services after forty-five days of the job being completed will result in Easy Rescue Services being no longer liable for charges relating to the job.

4.7 Invoices must be submitted electronically ideally in PDF format to accounts@easyrescue.co.uk.

  1. SUBCONTRACTING

It is expressly forbidden that any jobs that have been subcontracted to you by Easy Rescue Services can be contracted out to another party, If you are unable to attend the job for any reason, please inform Easy Rescue Services immediately and we will reallocate the job to another Tyre Fitting Partner. If it is found that jobs have been contracted out by you, all invoices from you will be deemed null and void and not paid.

  1. COMPLAINTS

Should any complaint be raised from one of our customers, you will be expected to provide full cooperation to bring the said complaint to a swift conclusion. This may require a written response either by email or letter along with any documentation/photos as requested. Easy Rescue Services must receive these from you within seven calendar days.

  1. DAMAGE TO PERSON OR PROPERTY

7.1 You shall indemnify and keep indemnified Easy Rescue Services from and against all direct and indirect loss, damage, costs, claims, expenses and any and all other liabilities including third-party claims, loss of profit, loss of sales, loss of goodwill, loss of business, loss of reputation, suffered by or threatened against Easy Rescue Services as a result of your breach of this Agreement or any negligent act or omission in providing subcontracting services to Easy Rescue Services.

7.2 Where you or Easy Rescue Services receive a claim from a Customer concerning alleged damage to a Customer’s Vehicle or personal injury to the Customer or a passenger in the Customer’s Vehicle, then full details must be forwarded to Easy Rescue Services immediately. If you receive a complaint, you must inform us by telephone immediately and where such a claim is received by us then Easy Rescue Services shall request any relevant information from you and carry out an assessment of liability. You shall provide any requested information to Easy Rescue Services as soon as possible and usually within 48 hours of receiving such a request.

7.3 Where Easy Rescue Services reasonably believes that you are either partially or wholly liable for the claim, Easy Rescue Services shall seek to mediate the claim between you and the claimant. Easy Rescue Services will attempt to mitigate the cost of the claim, where possible. In such cases, you shall indemnify and keep indemnified Easy Rescue Services against all costs, claims, losses, liabilities, expenses, or damages.

  1. SEVERABILITY
    In the event that any terms of this agreement are held by a court of competent jurisdiction to be unenforceable or unlawful for any reason, such terms held to that extent only will be removed from this agreement and the remainder of this agreement shall remain in full force and effect.
  2. SOCIAL MEDIA

Social media allows for the creation and exchange of user-generated content. In relation to these matters Easy Rescue Services apply a restrictive Covenant, under no circumstances unless express permission is granted in writing are you to post any photographs, create or exchange any user-generated content relating to Easy Rescue Services or its customers, comment or mention Easy Rescue Services in any way in relation to any business between our companies.

 

  1. JURISDICTION

This agreement is governed by and construed in accordance with the laws of the country in which the contract was agreed. Any dispute arising out of the terms of the agreement will be determined exclusively by the courts in that country.

 

By registering as a Tyre Fitting Partner you are agreeing to our terms and conditions.
